These Terms and Conditions ("Terms") set out the terms and conditions governing the use of this website (www.nu-in.com) and the purchase of products through this website provided by NU-IN ("Company," "we," "us," or "our") to the customers ("you," "your," or "yours"). By using our website, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our website.
They apply to all orders placed on the domain nu-in.com and sub-domains. By ordering any product from this website, you enter into a contract with us under these terms.
This website is operated by NU-IN Fashion Limited, an Irish company with company number 66271, whose registered office address is at 13 Classon House, Dundrum Business Park, Dundrum Dublin 14, VAT Nº IE3666363JH.

PLACING AN ORDER
By placing an order, you confirm that you have read these terms and conditions and you accept them. When we have received your order, you will receive an email from us confirming receipt of your order. Any order is subject to NU-IN’s respective acceptance, which shall always be confirmed by sending an email communicating the product shipment. The contract will only be finalized when we send you the shipment confirmation.
Orders can only be placed by persons that are 18 years or older and legally capable of entering into binding contracts.
PRICE AND PAYMENT
Depending on your location, our website is defaulted to show the following currencies: Euro (€), British Pound (£) and United States Dollar ($). More currencies may be available depending on your location, being converted from Euros simultaneously at the exchange rate of that moment. The prices on the website include VAT but exclude delivery costs, which will be calculated and displayed during the checkout stage.
Please note that when paying in non-EUR currency, Shopify (when paying via card) or PayPal will convert other currencies to EUR and may also add exchange fees. As a result, the final price they will charge you is neither defined nor controlled by nu-in.
We will deliver your order within 30 working days. If a delivery is delayed for more than that period, you are entitled to cancel your purchase.
All orders are subject to availability and in the event of supply difficulties or because items are no longer in stock.
Payment can be made by American Express, Apple Pay, Google Pay, Maestro, PayPal, Mastercard, Shop Pay, Clearpay and Visa.

CANCELLATION & RETURNS
Without prejudice to your statutory rights, products purchased from nu-in.com can be returned or exchanged, the latter if available, within 30 days from the date of purchase unless the exceptions mentioned below apply:
- Products which are not suitable for return due to health protection or hygienic reasons (designated products stated on Return Policy);
- Unclean, damaged and/or worn items and items with missing tags.
All returns can only be accepted if compliant with our Return Policy.
LIABILITY
We make no warranties in relation to this website or the information, materials and contents, made available.
We only supply the products for private use. You agree not to use the products, website or any other services provided by us for any commercial, business or re-sale purpose, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. You also agree that we are not responsible or liable under any circumstances for any computer viruses, system failure or malfunction which may occur in connection with your use of this website.
INTELLECTUAL PROPERTY
All copyrights, trademarks and other intellectual property rights in all material or content supplied as part of the website shall remain at all times vested in us or our licensors. It is forbidden to copy, reproduce, download, post, transfer or distribute any document which comes from the website.

We may have links from our website to other third party websites and materials; such links are provided exclusively for information purposes and we do not have any control whatsoever over the contents of such websites or materials. SEVERABILITY
If any of these Terms or any provisions becomes unenforceable or invalid in any jurisdiction, court or authority, the remaining provision and all other provisions will remain in full force and effect.

SECOND-HAND TERMS & CONDITIONS
GENERAL
a. We offer second-hand clothing items that have been thoroughly inspected to ensure they match the description provided by the seller, are in good condition, and are fit for resale.
b. All second-hand items are sold as-is and we do not accept returns or exchanges on these items unless they are found to be in a significantly different condition than described.
c. We make every effort to accurately describe the condition, size, and fit of each second-hand item, but please note that there may be minor variations in colour or texture due to the nature of second-hand clothing.
DEFINITIONS
Within the meaning of these Terms, a consumer is any individual, who concludes a transaction for purposes, which cannot be primarily attributed to his or her occupational activities (employed or self-employed).
A seller is a private buyer, who commissions nu-in to offer, market and sell the sales item designated for sale.
A buyer is a private buyer, who makes an offer to buy a sales item offered by nu-in on the nu-in website.
A Sales item is a nu-in second-hand item offered by nu-in from sellers through the nu-in website.
ELIGIBILITY RULES FOR SELLERS

Your nu-in garment was purchased at www.nu-in.com.

Garments must include original sewn-in brand and care labels.

Perfect condition (no signs of use)

LIST YOUR PRE-LOVED GARMENT
As a seller in the Second-Hand market, you must wash, clean, and iron (if not advised against in the care label) their garments before listing them. You must also take pictures of your garment from different angles and with good lighting.
To submit your listing request, access our Portal, and indicate your original purchase order number and your email address.
If you’re not sure what is your order number, please access your customer profile to see your orders history.
After submitting your Second-Hand listing request, it will be reviewed by the nu-in team and you’ll be notified about the outcome.
YOU SOLD YOUR GARMENT
Once a garment is sold, Nu-in will provide the seller with a pre-paid return label, and the seller must pack and ship the sold garment within 5 business days.
Upon receiving the garment in the warehouse, nu-in will proceed with a physical inspection.
YOUR RECOMPENSE
After your garment has passed the physical inspection, you’ll receive a store credit corresponding to the listed value within 5 business days.
The store credit is redeemable at www.nu-in.com in purchases equal to or superior to the store credit value within 6 months from the issue date. This store credit cannot be retrieved in Second-Hand market purchases. The store credit is linked to the customer account, it is non-transferable and cannot be replaced by cash or any other payment method.
IF YOUR GARMENT FAILS PHYSICAL INSPECTION
The garments to be found in an unsatisfactory condition, not matching the description and or/state declared will be rejected. In such cases, the procedure is as follows:

The buyer is contacted and is given the option to continue the purchase by benefiting from a reduction of price or give up on their purchase.

In case the buyer gives up on the purchase, the product will be relisted at a reduced price if still in suitable condition otherwise, the garment will be recycled

The seller will be penalized with a fine of 20% of the actual selling price (not the price initially listed) or will be given a voucher of 5 EUR in case the garment is recycled.
SOURCING AND INSPECTION
a. We source second-hand items that were pre-owned by nu-in customers.
b. All second-hand items undergo a thorough physical inspection once they are received at our warehouse and before being shipped to the buyer.
c. We reserve the right to reject any second-hand items that do not meet our quality standards or are found to be inauthentic.
PLACING AN ORDER
By placing an order including a Second-Hand item you are agreeing to these Second-Hand Terms & Conditions. Our general Terms & Conditions apply for matters not stated here.
PRICING AND PAYMENT
a. The price of each second-hand item is suggested by nu-in based on its condition, rarity, and market value but it will ultimately be determined by the seller.
b. The buyer must bear the separate shipping costs for each second-hand item. The amount of shipping costs can be found on the Shipping page.
c. All prices are listed in EUR.
d. Payment for second-hand items is accepted through our regular payment methods. Special shipping and Return Policies apply and are stated on each second-hand item listing page.
OWNERSHIP AND COPYRIGHT
All second-hand items sold on our website remain the property of the original owner (seller), and we do not claim any ownership or copyright over them.
We use images and descriptions of the original item that was sold on our website while also using some content which the property of the original owner, and we use them with their permission.
LIMITATION OF LIABILITY
a. We make every effort to accurately describe the condition, size, and fit of each second-hand item, but we cannot be held liable for any errors or omissions in these descriptions.
b. Customers who purchase second-hand items from us agree to indemnify and hold us harmless against any claims, damages, or expenses arising from the use or resale of these items.
c. Customers who sell second-hand items to us agree to indemnify and hold us harmless against any claims, damages, or expenses arising from the sale or authenticity of these items.
CANCELLATION & RETURNS
The seller can cancel their sale at any time, by emailing us at customer.care@nu-in.com. If an item is sold and the seller has not shipped the item back within 5 business days, the sale is automatically cancelled and the buyer will be notified.
The sellers at our Second-Hand Market are also a customer and for this reason, the buyer is not entitled to a right of cancellation under applicable law. However, nu-in offers the option to cancel the order by emailing us at customer.care@nu-in.com. Cancellations may be possible if the seller has not yet shipped the item back and it depends on the timely responsiveness of the seller.
Returns and exchanges are not accepted unless the item is found to be in a significantly different condition than what was described by the seller.

REPAIR SERVICE TERMS & CONDITIONS
GENERAL
We offer repair services for nu-in items only. Our repair service includes mending, fixing, and restoring your item or modifying it to the best of our ability. In case, you would like your item to be restored, we cannot guarantee that the repaired item will be in the exact same condition as it was when you first purchased it.
ELIGIBILITY
To be eligible for our repair service, you must have purchased the item at nu-in.com.
The item must also be repairable and you must complete the payment of the value according to the service requested.
REPAIR PROCESS
To initiate the repair process, you must fill out our Repair Request form and provide a detailed description of the damage. When submitting your request, you will find the price corresponding to the repair you selected. We will review your request and determine whether your item is eligible for repair.
SHIPPING
If your item is eligible for repair, you will be provided with a pre-paid return label to return your item along with return instructions.
PAYMENT
You must pay for the repair services before we start the repair process. We will provide you with an invoice for the estimated cost, which you can pay through our website.
WARRANTY
We offer a 30-day warranty for our repair services after you receive your repaired item. If you have any issues with the repaired item during the warranty period, please contact us immediately. We will review the issue and determine whether it is covered by the warranty.
LIMITATION OF LIABILITY
Our liability for any damages arising from our repair services is limited to the amount you paid for the repair services. We are not liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits or revenue.

ITEMS AVAILABILITY
Each Mystery Box contains a selection of up to 3 items of womenswear. The items included in the Mystery Box have a commercial value that is higher than the price of the box.
The Mystery Box items will vary according to each of the themes offered. The themes available may change periodically, check the current offer of themes here.
The items selected for each Mystery Box theme are curated by the nu-in team.
CANCELLATIONS & RETURNS
Orders can be cancelled before shipment. Each cancellation request will need to be verified with our warehouse before being processed. After the cancellation request is successfully completed, you will receive a full refund.
A Mystery Box can be returned in full by following our Return Policy. A partial return of a Mystery Box may be allowed only upon acceptance of our customer care team.

These Terms and Conditions set the terms for the Blank Canvas project and apply to all orders placed on the domain nu-in.com and sub-domains from 13/11/2022 onwards which include a Print-on-Demand item.
PLACING AN ORDER
By placing an order including a Print-on-Demand item you are agreeing to these Print-on-Demand Terms & Conditions. Our general Terms & Conditions apply for matters not stated here.
PRICE AND PAYMENT
Payment will be done upfront when placing the order. As a general procedure, your items will then be processed for delivery once the Print-on-Demand items have arrived at our warehouse.
After the general timing of 2 weeks that is needed for Print-on-Demand items to be printed, packed and shipped, our general Shipping & Delivery policies apply, check them here.
ITEMS AVAILABILITY
Items availability cannot be 100% guaranteed, as production can be subject to external factors that may be outside of nu-in's control. In this unlikely case, you will, of course, be refunded.
There is no waitlist, all Print-on-Demand items are sold on a first-come-first-serve basis, and nu-in is unable to hold or reserve items.
Each Print-on-Demand design is available for purchase for the length of time stated on its own product page.

SPECIAL OFFERS TERMS & CONDITIONS
GENERAL
NU-IN’s special offers campaigns are organized by NU-IN FASHION LTD, 13 Classon House, Dundrum Business Park, Dundrum Dublin 14, D14 W9Y3 (hereinafter referred to as “NU-IN” or "Organiser"). These Special Offers' general terms and conditions apply to any and all Special offers campaigns organized by NU-IN, which may in particular include:
- special prices – i.e. lowering prices of all products or products from a selected category currently offered by the Organizer during the period of validity of such special offer;
- special offers on shipping fees – i.e. covered by NU-IN in part or in full shipping fees for goods of a particular value purchased during the period of validity of such special offer;
- special gifts – i.e. gifts provided by the Organizer after purchasing products from a selected category or products of a particular value offered by NU-IN during the period of validity of such special offer;
- conditional special offers – i.e. after reaching a certain order value announced or satisfying certain purchasing conditions announced.
- unconditional special offers - i.e. unconditionally granting a discount code for the next purchase.
COMMUNICATION
Special offers shall be provided by NU-IN in accordance with the principles set out in these Terms and Conditions, amended by announcements provided in this section, sent via NU-IN Newsletter, NU-IN social media channels or published in other forms. Should a formula of a particular special offer differ from the rules defined in this section, its conditions shall be defined in separate terms and conditions document.
An announcement of a special offer shall define in particular its character, conditions for participation, timeframe, territorial scope, and the group of NU-IN customers to the offer is applicable.
Each special offer has a timeframe provided in its announcement. The Organizer reserves the right to cancel any special offer at any time.
The 15% discount on the Halloween Weekend collection occurs from the 29th to the 31st of October 2022. 5% of all net sales will be donated to the @crescer_org association and the support they give to the most vulnerable in our society.
ELIGIBILITY
Participation in special offers is free of charge and voluntary. A special offer can be used at any time during its period of validity.
Participation in special offers is open to a natural person, legal person, or organisational unit not having legal personality, to whom legal capacity is granted by the act (hereinafter referred to as a "Participant"), after satisfying all of the following conditions:
- owning a customer account at www.nu-in.com;
- have read and accepted in full the provisions of these Terms and Conditions;
- have a place of residence or registered office in the location covered by a particular special offer with limited territorial scope;
- are members of a group of NU-IN customers to whom the particular special offer is addressed, in case of special offers apply only to selected categories of customers;
- have satisfied all the conditions of eligibility for a special offer defined in the announcement and in these Terms and Conditions;
- entering by the Participant and the Organizer into a sales or delivery agreement for goods in NU-IN's offer, and executing such agreements is not prohibited by Irish or international law.
LIMITATION OF LIABILITY
Should the Participant be granted a discount code for their next purchase at NU-IN, the validity period of such discount code and the rules of redeeming it shall be defined in the announcement of the special offer.
Special offers cannot be combined with any other discounts, especially with individual discounts unless detailed terms and conditions of a given special offer state otherwise.
Special prices do not apply to shipping fees unless the contents of the announcement state otherwise.
If a special offer is about the Organizer granting a gift to the Participant after satisfying certain conditions or unconditionally, the Participant is eligible for receiving such gift only once. The gift shall be added to a parcel with the goods ordered, or delivered to the Participant in a separate parcel at the expense of NU-IN. Should the Participant execute their statutory right to withdraw from a distance agreement, such gift shall be returned along with the returned goods, in accordance with the rules stipulated by the law.
Participation in a special offer is a confirmation that the Participant has read and accepted the announcement of the special offer and these Terms and Conditions.
CANCELLATION & AMENDMENTS
If things go wrong and, despite the Organizer’s best endeavours, they are unable to administer the Special Offers fairly or properly, the Organizer is not responsible and has the right to cancel or change the Special Offer for a significant reason, providing that such alterations do not infringe rights acquired by the Participants. Any such alterations of the provisions of these Terms and Conditions during a live campaign shall be included in the form of an Appendix to these Terms and Conditions, which shall be an integral part of these Terms and Conditions.

GIVEAWAYS TERMS & CONDITIONS
GENERAL
nu-in’s Giveaways and Promotions are organized by NU-IN FASHION LTD, 13 Classon House, Dundrum Business Park, Dundrum Dublin 14, D14 W9Y3 (hereinafter referred to as “NU-IN” or "Promoter”). These Giveaway general terms and conditions apply to any and all Giveaways organized by NU-IN.
ELIGIBILITY
Participation in Giveaways is only open to legal residents of the countries listed on-site where www.nu-in.com ships and to those who are aged 16 years or over (hereinafter referred to as a "Participant"). NU-IN may ask the Participant, at any stage, to provide us with proof of age and/or identity and/or parental approval, if relevant. Anyone professionally associated with any Giveaway or Promotion is ineligible to enter.
DATE OF GIVEAWAYS
The Giveaways shall start and close on the dates announced at www.nu-in.com and/or newsletter and/or NU-IN social media channels. Entries after the closing date will not be considered.
HOW TO ENTER
The entry procedure is explained in the Giveaways announcement on the aforementioned platforms. There is no cost to enter the Giveaways, and no purchase is required. Only one entry per person will be accepted and repeated entries from the same Participant will result in disqualification, unless informed otherwise.
THE WINNERS
Participants will be selected at random by www.nu-in.com and the winners will be announced on the Giveaway designated date on NU-IN social media channels and/or newsletter.
Winners will be notified via email within 72 hours of competition closure hours after.
MODERATION
The Promoter will reject entries which, in the reasonable opinion of the Promoter:
- contains any content that is offensive or could reflect negatively on the name, reputation, or goodwill of the Promoter or any brand partner;
- includes trademarks, logos, or copyright material not owned by you or used without the rights owner's prior written permission (including famous names, company names, etc.);
- defames, misrepresents, or insults other people or companies, including, but not limited to the Promoter (including its partners);
- promotes any political agenda.
PRIZE
The Giveaway prize should be NU-IN product as indicated on the Giveaway announcement. Prizes are non-transferable, and non-returnable and no cash or other alternative to the prizes are available in whole or in part. In the event of unforeseen circumstances, the Promoter reserves the right to substitute an alternative Prize of equal or greater value.
PERSONAL DATA
By entering, winners agree to participate in any reasonable publicity arranged by the Promoter or by its agencies. If you are the winner of the Giveaway, you agree that the Promoter may use your name, image and town or county of residence to announce the winner of this competition and for any other reasonable and related promotional purposes.
By entering any Giveaway organized by NU-IN, all Participants will be deemed to have accepted that they are bound by the terms and conditions.
CANCELLATION & AMENDMENTS
If things go wrong and, despite the Promoter’s best endeavors, they are unable to administer the Giveaway fairly or properly, the Promoter and their affiliated companies are not responsible and have the right to cancel or change the Giveaway. They will only do this in exceptional circumstances. The Promoter also has the right to disqualify a Participant if they tamper or abuse the entry process and they will not be entitled to the prize if they have acted fraudulently or dishonestly.
LIMITATION OF LIABILITY
No liability is accepted for illegible, incomplete or late entries.
The Giveaway is in no way sponsored, endorsed or administered by, or associated with Instagram. By entering the Giveaway, all entrants are providing Instagram with a complete release from any and all legal liability in connection with the Giveaway.
The Promoter will only use the personal details supplied for the running of the Giveaway and for no other purpose unless we have your explicit consent.
All entries must be made directly by the person entering the Giveaway.
Bulk entries from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries and entries which do not satisfy the requirements of these terms and conditions in full will be disqualified and will not be counted.
The Promoter may refuse to award a prize, or seek its recovery, in the event of an entrant's fraud, dishonesty or non-entitlement under these terms and conditions.
The Promoter cannot accept any responsibility for any damage, loss or injury suffered by any entrant entering the Giveaway or as a result of accepting or participating in any prize.
